Terms of Service

1. Acceptance of Terms

By accessing or using the DraftEngine platform ("Service"), operated by White Towers Group LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and subscribers. Additional terms may apply to specific features (e.g., API access, Enterprise plans) and will be presented when you access those features.

2. Description of Service

DraftEngine is a digital marketplace for permit-ready construction plan sets tailored to Florida building codes. Our services include:

  • Browsing and purchasing pre-engineered plan sets (HVAC, roofing, plumbing, electrical, etc.)
  • AI-powered compliance reviews against the Florida Building Code
  • Document analysis via Claude Vision AI
  • DXF/CAD export capabilities (Pro and Enterprise plans)
  • REST API access for programmatic integrations (Pro and Enterprise plans)

3. Accounts and Registration

To purchase plan sets or use premium features, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions, Credits, and Billing

4.1 Subscription Plans

DraftEngine offers monthly and annual subscription plans (Starter, Pro, Enterprise). Plan features, credit allocations, and pricing are displayed on our Pricing page and may change with notice.

4.2 Credits

Each plan includes a monthly credit allocation. Credits are consumed by operations such as compliance reviews, AI analysis, and DXF exports. Unused credits do not carry over to the next billing cycle. Additional credit packs may be purchased.

4.3 Billing

Payments are processed through Stripe. By subscribing, you authorize recurring charges on your payment method. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4.4 Refunds

Digital plan sets are non-refundable once downloaded. If a plan set contains a material error or does not match its description, contact support and we will provide a corrected version or issue a credit at our discretion.

5. Plan Sets and Intellectual Property

5.1 License Grant

When you purchase a plan set, you receive a non-exclusive, non-transferable license to use the plan set for a single permit submission at the specified jurisdiction. You may not resell, redistribute, or sublicense plan sets.

5.2 Ownership

All plan sets, compliance engines, software, content, and intellectual property on the DraftEngine platform are owned by or licensed to White Towers Group LLC. These Terms do not transfer any ownership rights to you.

5.3 User Content

You retain ownership of documents you upload for compliance review. By uploading, you grant us a limited license to process, analyze, and store the documents as necessary to provide the Service.

6. Compliance Disclaimer

While DraftEngine plans are designed to be permit-ready and verified against the Florida Building Code (8th Edition, 2023) and local amendments, we do not guarantee permit approval. Approval decisions are solely at the discretion of the Authority Having Jurisdiction (AHJ).

Plans are provided for informational and construction documentation purposes. They do not constitute engineering advice. Users are responsible for engaging appropriate licensed professionals as required by their jurisdiction.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the platform
  • Circumvent rate limits, access controls, or security measures
  • Scrape, crawl, or systematically download plan sets or platform content
  • Impersonate another person or misrepresent your affiliation
  • Upload malicious content, viruses, or code designed to interfere with the Service
  • Resell or redistribute purchased plan sets without written authorization

8. API Terms

If your subscription includes API access, the following additional terms apply:

  • API usage is subject to rate limits specified in your plan
  • API keys are confidential and must not be shared or exposed in client-side code
  • We may suspend API access for abuse, excessive errors, or violations of these Terms
  • API responses are subject to the same licensing terms as platform content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAFTENGINE AND WHITE TOWERS GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless DraftEngine, White Towers Group LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Termination

Either party may terminate the relationship at any time. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your license to use purchased plan sets survives, but access to platform features (compliance reviews, API, credits) ceases.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.
